This document details the warranties offered by Paul Clark Services Ltd (The Company) in relationship to goods and services supplied in respect of fixed price work, repairs and support. The standard warranty is the warranty referred to in PCS general Terms and Conditions.
New Products
New or reconditioned products will be covered by the manufacturer’s standard warranty for the product in its intended application only. In most cases the Company only supplies the labour involved with the agreed repair or components changed.
Rebuilt Engines, Transmissions and Final drives (major unit)
The rebuilt major unit warranty only applies to the manufacturer and supplier of the rebuilt engine, transmission and final drive unit. Any major unit failure resulting from workmanship supplied by the Company will be investigated in cooperation with the operator, and remanufacturer/supplier. The manufacturer’s warranty will apply.
Repairs and Servicing
This warranty applies to repairs, maintenance and servicing work carried out by the Company.
The service work warranty covers any failure to the component or equipment subject to the service work that results, under normal use and service, from defective workmanship. The service work warranty coverage commences on the day the job is completed and ends at a period of 6 months, 25,000 miles or 1,000 hours of operation from this date, whichever occurs first.
The company will be responsible for any failure covered by the service work warranty and is limited to repairing or at its option replacing any part of the defective service work. The company will bear any reasonable labour costs to repair the defective service work, including replacement parts. Travel costs could be incurred if the fault is found not to be as a result of poor workmanship by the Company.
Parts and Accessories
Any new parts or accessories supplied by the Company will be covered by the manufacturer’s standard warranty for the product.
Any parts left in the equipment or reused in the service work will be covered only by any previous applicable warranty.
Warranty Procedure
Subject always to any relevant procedures associated with the manufacturer’s warranties, where the customer believes that a failure should be covered by the standard warranty, it shall notify the Company immediately and agree to make the service work available for examination and analysis of the failure at their own premises (The customer must not interfere with, modify, strip or attempt to undertake any repair to any work warranted by the Company. Failing to comply could invalidate all warranty cover). The Company will assess, in its own opinion if the failure is covered by the standard warranty. The Company may carry out the relevant work to repair the fault, but reserve the right to invoice the customer if (1) PCS is assessing whether the fault is covered by the standard warranty; and/or (2) a warranty claim is made with the supplier/manufacturer.
Warranty Limitations
The owner is responsible for the operation and maintenance of the engine, major unit or equipment as specified by the manufacturer’s operation and maintenance manuals, and should retain appropriate documentary evidence to substantiate compliance and make this available to the Company should it be required to support the warranty consideration claim.
PCS is not responsible for failures resulting from the owner or operator misusing, abusing, neglecting, or accidental damage including (but not limited to): operation without adequate coolant, fuel or lubricants (manufacturer’s approved specification); over fuelling; over speeding; lack of maintenance of lubricating, cooling or intake systems; improper storage, starting, warm up, run in or shut down practices; unauthorised modifications to the equipment. The Company is also not responsible for failures by incorrect oil, fuel, or by water, dirt or other contaminants in the fuel or oil.
The Company will not accept liability for the reused parts failures and for consequential damage as a result of this failure.
The Company is not responsible for failures resulting from the improper repair or installation by others or used parts not approved by the vehicle manufacturer. This warranty shall not apply to any workmanship, part, or parts that have been altered or repaired by other than the Company.
The owner is responsible for the costs or towing, lubricating oil, anti-freeze, filter elements, hoses, belts, and other items replaced during warranty repairs.
The owner is responsible for “down time” expenses, fines, cargo damage, all applicable taxes, loss of profit or loss of bargain, and all other business costs and losses resulting from a warranty failure.
The Company will not be responsible for incidental, indirect or consequential damages
The Company does not cover wear or wearout of covered parts
The standard warranty is the sole warranty offered by the Company in relationship to any goods or services it supplies, save for this standard warranty, all other warranties, representations, conditions and other terms, either expressed or implied, including any warranty or mechantability or fitness for a particular use are excluded to the maximum extent permissable by law.
